This can take various forms, such as:<\/p>\n<ul>\n<li>Defective execution: For example, leaky windows, uneven floors, or faulty electrical installations.<\/li>\n<li>Use of inferior materials: For example, the installation of materials that do not meet the agreed standards.<\/li>\n<li>Non-compliance with construction plans: If the construction work does not correspond to the approved plans.<\/li>\n<\/ul>\n<h2 id=\"page-baumangel-richtig-dokumentieren\"><strong>Properly documenting construction defects<\/strong><\/h2>\n<p>Before reporting the construction company's defects, you should document them carefully. Thorough documentation serves as evidence and makes it easier to prove the defect. This includes:<\/p>\n<ul>\n<li>Photographs: Take detailed photos of the affected areas from various perspectives.<\/li>\n<li>Minutes: Record in a written report which defects you have identified and when they occurred.<\/li>\n<li>Expert opinion: In more complex cases, it can be useful to consult an independent expert to prepare an expert opinion on the defect.<\/li>\n<\/ul>\n<h2 id=\"page-baumangel-der-baufirma-anzeigen\"><strong>report construction defects of the construction company<\/strong><\/h2>\n<p>After you have adequately documented the defects, you should formally report them to the construction company. These documents are important in the event of a legal dispute.<\/li>\n<\/ul>\n<h2 id=\"page-rechtliche-schritte-bei-nichterfullung\"><strong>Legal action in case of non-performance<\/strong><\/h2>\n<p><strong>\u00a0<\/strong>If the construction company does not respond or refuses to rectify the defects, you have several legal options:<\/p>\n<ul>\n<li>Self-performance: After the fruitless expiration of the deadline, you can have the defects remedied by another company at the construction company's expense.<\/li>\n<li>Reduction: You can reduce the contract price in accordance with the defects.<\/li>\n<li>Compensation for damages: If you have suffered damage as a result of the defects, you can claim damages.<\/li>\n<li>Withdrawal from the contract: In severe cases, you have the right to withdraw from the contract.<\/li>\n<\/ul>\n<h2 id=\"page-verjahrungsfristen-beachten\"><strong>Observe limitation periods<\/strong><\/h2>\n<p>You must also observe limitation periods when asserting construction defects. As a rule, the limitation period for defect claims is three years from the acceptance of the building.
