IT contracts, software and licensing

ATB.LAW drafts, reviews, and negotiates IT contracts of all kinds. We support IT projects from the tender process through contract negotiation to final acceptance.

A special focus is placed on the legal protection of software, source code, exploitation rights, and license models. We advise on the chain of title regarding employees and external developers, open-source software, and the legally secure commercial exploitation of digital products.

Artificial Intelligence, Data Law and Data Act

ATB.LAW supports companies in the legally compliant development and use of AI systems. We advise on risk classification under the AI Act, transparency requirements, labeling obligations, documentation duties, AI governance, training concepts, liability issues, and contract drafting in AI projects.

In addition, we advise on data law and the data economy. This includes data access rights, data use rights, data license agreements, strategies for legally compliant data collection, data exploitation and data monetization, as well as the protection of data against third parties. An important regulatory framework in this regard is the Data Act.

Cybersecurity, NIS 2, DORA and Cyber Resilience Act

ATB.LAW provides comprehensive advice to companies on cybersecurity and regulatory IT compliance. We examine whether companies fall under the NIS 2 Directive or the Austrian NISG 2026, assist with the implementation of organizational and technical measures, and support them with documentation, governance, and reporting obligations to authorities.

We advise financial entities and ICT third-party service providers on DORA. This includes ICT risk management, third-party risk, digital resilience testing, and incident reporting. Platform regulation, e-commerce, and digital business models data protection

We review platform terms and conditions, advise on rankings, reviews, transparency obligations, complaint mechanisms, account suspensions, and unilateral platform decisions.

We draft terms and conditions, customer terms, terms of use, cancellation policies, information requirements, and legally compliant processes. In addition, we advise on advertising, pricing, online reviews, influencer marketing, warning letters, and legal disputes.

ATB.LAW checks websites and digital presences for legal compliance. This includes legal notices, privacy policies, cookie banners, tracking setups, accessibility in accordance with the Accessibility Act, as well as legal issues regarding domains, naming rights, and digital content.

In IT transactions, we accompany the sale of software solutions, IT assets, and know-how. We advise on IT-related parts of M&A transactions, protect IP rights, license positions, software rights, and existing contractual structures, and assist with legal due diligence.
